1. About ExitProof

ExitProof (operated by Altitude Group Pty Ltd, ACN 678 543 210, ABN 12 345 678 901) provides an online tax residency exit planning platform at exitproof.com.au. The service helps Australian high earners evaluate whether and how to change their tax residency, build an evidence trail, and maintain compliance following a residency transition.

By using this website you agree to these Terms & Conditions in full. If you do not agree, do not use ExitProof.

2. Services and Subscriptions

ExitProof offers three service tiers:

  • Stage 1 — Exit Wealth Calculator (Free). A no-account-required financial comparison tool. Outputs are indicative only.
  • Stage 2 — Exit Planning ($197/month, founder offer). A structured planning workflow including the Day-7 Diagnostic, monthly evidence actions, jurisdiction research, pre-departure checklist, and a counsel-ready evidence file export. This is a monthly subscription with no lock-in.
  • Stage 3 — Ongoing Compliance ($99/month). A live compliance dashboard for users who have completed Stage 2 and need year-over-year residency maintenance. Includes days-in-AU tracking, evidence vault, and action queue.

All prices are in Australian dollars and inclusive of GST unless stated. Fees are charged monthly in advance. We reserve the right to change pricing with 30 days' notice to the email associated with your account.

3. Eligibility

ExitProof is designed for Australian residents with individual income of $200,000 or more who are considering a tax residency change. You must be at least 18 years old and capable of forming a binding legal contract to use the paid services.

We may restrict access to certain features based on residency, jurisdiction, or other eligibility criteria at our discretion.

4. Your Account

To access Stage 2 and Stage 3 services you must create an account with accurate information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at privacy@exitproof.com.au.

We reserve the right to suspend or close accounts that provide false information, attempt to circumvent our systems, or use the platform for any unlawful purpose.

5. Cancellation and Refunds

You may cancel your Stage 2 or Stage 3 subscription at any time from your account page. Cancellations take effect at the end of the current billing period — there is no partial-month refund.

After cancellation your data (calculator submissions, evidence uploads, action completions) remains accessible for 30 days, after which it may be permanently deleted. We do not guarantee data retention beyond the cancellation date.

We do not offer refunds for months already charged unless required by applicable law.

6. Important Disclaimers

No guarantee of non-residency or tax outcome. ExitProof is a planning workflow tool. Using ExitProof does not guarantee that the ATO will accept any particular tax residency determination. Residency outcomes depend on individual facts and ATO assessment — not on the quality of a planning workflow. All planning outputs should be reviewed by a qualified Australian tax professional before making any residency determination.

ExitProof specifically disclaims:

  • Any representation that using the service will result in a non-residency finding by the ATO
  • Any guarantee of tax savings, reduced tax liability, or specific financial outcome
  • Legal advice — ExitProof is not a law firm, and no output constitutes legal advice
  • Tax advice — ExitProof is not a registered tax agent, and no output constitutes formal tax advice
  • Accuracy of third-party information — tax rules, treaty provisions, and foreign residency requirements change; we endeavour to keep content current but do not guarantee real-time accuracy

Users must obtain independent professional advice (tax agent, lawyer, or both) before relying on any ExitProof output to make residency decisions.

7. Intellectual Property

All content on exitproof.com.au — including text, graphics, logos, software, databases, and layout — is the intellectual property of Altitude Group Pty Ltd unless otherwise noted. You may not reproduce, distribute, modify, or create derivative works from any ExitProof content without prior written consent.

User-generated content you upload to ExitProof (evidence documents, travel records, notes) remains your property. You grant us a non-exclusive licence to use, store, and process that content for the purpose of delivering the service.

8. Limitation of Liability

To the fullest extent permitted by Australian law, Altitude Group Pty Ltd excludes all liability for any loss, damage, cost, or expense arising from your use of ExitProof — whether direct, indirect, incidental, consequential, or punitive.

This includes but is not limited to: loss arising from ATO decisions, reliance on planning outputs without professional review, third-party actions, service interruptions, data loss, or errors in calculator outputs.

Our total liability in any circumstance is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

9. User Obligations

When using ExitProof you must:

  • Provide accurate information — false inputs produce unreliable outputs
  • Not use ExitProof to plan, facilitate, or execute tax evasion
  • Not attempt to access another user's account or data
  • Not use automated tools, bots, or scrapers to extract content from the site
  • Comply with all applicable Australian and foreign laws in connection with your use of the service
  • Maintain the confidentiality of your account credentials

ExitProof is not designed to assist with tax evasion or any activity that contravenes Australian tax law, the Criminal Code Act 1995 (Cth), or the tax laws of any destination jurisdiction.

10. Account Termination

We may terminate or suspend your account immediately, without notice, if we reasonably believe you have:

  • Violated these Terms & Conditions
  • Used the service for an unlawful purpose
  • Provided false or misleading information
  • Failed to pay fees when due

Termination does not entitle you to a refund of fees already charged.

11. Governing Law

These Terms & Conditions are governed by the law of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect.
